Staff Rules and Regulations

 
     
  The Staff Rules applies to all employees of Perfect enroller India Private Limited, which are referred to in this rule as Company or the Company.

Employees have a personal responsibility to protect this reputation of Company and to act with honesty and integrity in all dealings with customers and each other. Employees should not take unfair advantage of anyone through manipulation, concealment, abuse of privileged information, misrepresentation of material facts, or any other unfair-dealing practice.

Compliance with all laws, rules and regulations related to Company activities is mandatory. Anyone violating the compliance may be subjected to disciplinary action, up to and including termination of employment.

 
 
  1. Workplace Commitments

    1. Equal Opportunity Employment : This company is an equal opportunity employer and does not unlawfully discriminate against employees or applicants for employment on the basis of an individual’s race, colour, religion, creed, sex, national origin, age, disability, marital status, veteran status or any other status protected by applicable law. This policy applies to all terms, conditions and privileges of employment, including recruitment, hiring, placement, compensation, promotion, discipline and termination.

    2. Sexual harassment / Other Discrimination Policy : Sexual harassment and other discriminatory harassment are illegal and violate Company policies. Actions or words of a sexual nature that harass or intimidate others are prohibited. Similarly, actions or words that harass or intimidate based on race, colour, religion, gender, sexual orientation, age, national origin, disability, covered veteran status, marital status or any other unlawful basis are also prohibited.

    3. Drug-Free / Alcohol-Free Environment : Employees are prohibited from unlawfully consuming, distributing, possessing, selling, or using controlled substances while on duty. In addition, employees may not be under the influence of any controlled substance, such as drugs or alcohol, while at work, on company premises or engaged in company business. Prescription drugs or over-the counter medications, taken as prescribed, are an exception to this policy. Anyone violating this policy may be subject to disciplinary action, up to and including termination.

  2. Company Policies and Procedures

    1. Professional Conduct : Employees should adhere to a standard of professional conduct and integrity. Employees should be respectful, courteous, and mindful of others feelings and needs. General cooperation between co-workers and supervisors is expected. Individuals who act in an unprofessional manner may be subject to disciplinary action.

    2. Dress Code : Employees are expected to dress appropriately for their individual work responsibilities and position.

    3. Company Property : Company property, such as equipment, vehicles, telephones, computers, and software, are to be used strictly for company business and are not for private use. Upon termination, employees are required to surrender any company property they possess.

    4. Privacy : Company retains the right to access all company property including computers, desks, file cabinets, storage facilities, and files and folders, electronic or otherwise, at any time. Employees should not entertain any expectations of privacy when on company grounds or while using company property. All documents, files, voice-mails and electronic information, including e-mails and other communications, created, received or maintained on or through company property are the property of the company, not the employee.

  3. Terms of Employment

    The terms of employment are as per the details contained in the appointment letter. The company reserves the right to amend, alter, change, any or all the terms and conditions governing employment. The company will also be the sole judge of the meaning and interpretation of all or any of these terms and conditions and its decision thereon shall be binding on all employees. Employees are required not to share the terms of contract with others including fellow employees.

    1. Any False information provided by an employee, may result to disciplinary action, up to and including termination.

    2. Continuation in employment is subject to continuing physical and mental fitness.

    3. All Employees are governed by the Shop & Establishment Factory Act 1948 / Factory Act 1948 and the amendments as applicable

    4. An Employee shall not work with another entity when employed at the Company, with or without pay.

    5. Employee may have to travel to, or may be transferred to any place in and outside India for work.

  4. Compensation

    1. Salaries are calculated on CTC basis. An employee’s taxation is his/her responsibility.

    2. Salaries are credited into the individual’s salary account by the 7th or next working days by 7th of the following month in arrears.

    3. Employees may be requested to work beyond normal working hours. A component of Overtime will be included in the monthly salary.

    4. In addition to the Salary, employees are given reimbursement for expenses incurred by the employee outside office premises.

  5. Leave Policy

    1. Employees are expected to be at work for 8 hours a day excluding breaks.

    2. Holiday is any Sunday, non-working Saturday or Public Holidays.

    3. Authorized leave is 2 days paid leave per 26 working days.

    4. Unauthorized Absence is any absence not pre-approved for those specific dates

    5. Compensatory off - an employee who has worked on a Holiday shall be entitled to Compensatory Leave. If during the course of a site visit, an individual has a Holiday, Travelling Expenses shall be paid for the day, and no Compensatory off will be eligible for being away from home on that day.

    6. Leave Provisions - Holidays will not count as leave if it is during an authorized leave period.

    7. Leave for more than 4 days must be approved 30 days in advance, with a handover of work.

    8. For unauthorized absence due to medical reasons, a registered Doctor’s certificate is needed

    9. Maternity leave shall be granted as per Maternity Act, 1961.

    10. Paternity Leave shall be granted for 5 days.

    11. Leave donation to another employee shall not be allowed.

    12. No extra leaves shall be granted.

    13. All days of unauthorized absence between two reporting days (including Holidays) shall amount to Leave without Pay (LWP).

    14. Unauthorized Absence will not be taken into account for calculating Leave.

    15. Prolonged Unauthorized absence may result in legal action or in termination of employment.

    16. After 5 days of unauthorized absence, 1st Show Cause Notice will be sent. If the employee doesn’t respond within 7 days, 2nd Show Cause Notice will be sent. If the employee doesn’t respond within 7 days, 3rd Show Cause Notice will be sent. If the employee doesn’t respond within 48 hours, the Company will assume that the person has left the Company voluntarily.

  6. Expense Forms

    If an expense advance is paid to an employee, employee should submit expense statements with bills within 24 hours of completion of the task. Salary of employee may be kept on hold till balance amount is settled. Expense statements without supporting bills and receipts may be rejected. Foreign exchange issued for overseas travel shall be accounted for only in the Currency issued.

  7. Insurance

    1. Any insurance policy purchased by Company is valid only so long employee is an active employee of the Company. An active Employee is one who is not on unauthorized absence for more than 3 days. In case an employee leaves during the cover term, the premium for the balance of that year shall be deducted from his final settlement.

    2. An employee must complete all formalities of the e-Pehchan Card issuance from the ESIC Centre within 8 days of joining the Company. An Employee not complying with the same shall be responsible for bearing any expenses arising from an accident or medical requirement.

    3. The Cover of the Employee under various insurance schemes varies from person to person, the risk assessed with his job and his age, salary and designation. The Entitlement of claim amount, hospitals and rooms for treatment therefore varies from person to person.

    4. An employee must, within 24 hours of the incident, submit all documentation to the Insurance Company, in case of a claim. The responsible person must be intimated immediately.

    5. If the Employee or any family member makes a decision which is in contradiction to the Insurance Company protocol, the Company is not liable for any claims, liabilities arising.

  8. Loans & Advances

    1. No advances or loans are given by the Company to any of the employees. Any person giving a personal loan to another individual associated with the Company, the Company is not liable for any such personal loan.

    2. No Employee shall directly deal with any customer or its representative in transactions involving direct purchases, borrowing or lending money.

  9. Stand by

    1. The Company reserves the right to enforce that the employee shifts base to any other city as “standby employee” at their own cost without additional compensation.

    2. Standby employees shall report to duty to office or the allocated site within 48 hours of intimation. Any delays may be counted as Unauthorized Absence.

    3. In case Employees are not contactable on phone or email, or are not able to report for duty as required, the entire period from the date the employee last reported to work to the next date of reporting shall be considered as Unauthorized Absence.

  10. Resignation

    1. To resign from the Company, an employee must submit a written resignation, and serve the notice period as per the Appointment Letter. This resignation must be accepted by Management to be valid. If the Employee is unable to serve notice, he/she shall pay prorated Gross Salary.

    2. In case of a resignation, the Company may relieve an Employee before the notice period ends, without having to compensate the Employee in lieu of the balance days of notice period.

    3. All Company property, registrations, certifications or funds issued to the Employee shall be returned to the Company at the time of resignation. Any damage to Company’s property shall be borne by the Employee and adjusted at the time of the final settlement. Any Company property or funds not returned may be considered as theft.

    4. Unutilized Leave may be availed during notice period, only if approved by Management. If is not granted during notice period, it may be en-cashed.

    5. If an employee is absent without giving his resignation and serving notice period, final settlement will be not be paid. The final settlement shall be paid within 45 days after Full and Final Procedure is completed.

    6. After submitting the resignation, the employee shall not communicate with any Customer unless instructed by Management.

  11. Termination

    1. The Company may terminate employment by giving notice as per the Appointment Letter, or pay Gross Salary excluding allowances instead. In case of indiscipline, misconduct, negligence, violation of Staff Rules and Regulations, illegal activities, employment shall be terminated without any notice or compensation. Losses to the Company because of such behaviour shall be compensated by the Employee.

    2. The age of retirement for Employees is 60 years.
